Terms of Service

These Terms of Service (“Terms”) govern your use of Securely Verify’s identity verification and document collection service, dashboard and API (the “Service”). “Securely Verify”, “we” and “us” mean the provider of the Service. “You” and “Customer” mean the business that creates an account. By creating an account, starting a trial or using the Service, you agree to these Terms. If you accept on behalf of a business, you confirm you have authority to bind it.

1. The Service

The Service lets you send secure links to people you need to verify (“End Users”), collect identity documents, selfies, liveness checks and other documents from them, and review the results. Results are signals to support your own decisions. We do not guarantee that every fraudulent attempt will be detected or that every genuine person will pass, and you remain responsible for the decisions you make.

Securely Verify is not a consumer reporting agency and the Service does not provide consumer reports. You must not use the Service, or any result from it, as a factor in determining a person’s eligibility for credit, insurance, employment, housing or any other purpose covered by the Fair Credit Reporting Act.

2. Accounts

  • You must give accurate business information and keep it up to date. We may verify your business before enabling live verifications and may decline or suspend any account.
  • You are responsible for your users, their credentials and all activity in your account. Two-factor authentication is required for dashboard access.
  • The Service is for business use only.

3. Free trial

New accounts may receive a 7-day free trial with the usage limits shown on our pricing page. No payment card is required. When the trial ends, new links are paused until you purchase a plan or a prepaid pack. We do not charge you unless you purchase.

4. Plans, billing and automatic renewal

  • Fees. Fees are those shown on our pricing page or in your order at the time of purchase. Plan fees are billed in advance; usage above your plan’s included amount is billed in arrears at your plan’s overage rate.
  • Automatic renewal. Monthly and annual plans renew automatically for the same term at the then-current price until you cancel. You authorize us and our payment processor to charge your payment method on each renewal. We email you a reminder before each renewal and notify you before any price change.
  • Cancellation. You can cancel at any time from your billing settings or by emailing support@securelyverify.io. Cancellation takes effect at the end of the current billing period, and your plan remains active until then.
  • Refunds. Fees are non-refundable, including for partial periods and unused verifications, except where required by law.
  • Taxes. Fees exclude taxes. You are responsible for applicable sales, use and similar taxes.
  • Price changes. We will give at least 30 days’ notice of price changes, which apply from your next renewal.
  • Late payment. If a payment fails, we may suspend the Service after reasonable notice until the balance is paid.

5. Your responsibilities

  • You must have a lawful purpose and legal basis for every verification and document request you send.
  • You are responsible for giving End Users any notices and obtaining any consents required by law, including under biometric privacy laws. The Service presents consent screens to End Users, but this does not replace your own obligations.
  • You must comply with our Acceptable Use Policy and all applicable laws.

6. Data protection

For personal data we process on your behalf, you are the controller (or business) and we are the processor (or service provider). Our Data Processing Agreement and Biometric Data Policy form part of these Terms. Our Privacy Policy explains how we handle information about our own customers and website visitors.

7. Security

We maintain administrative, technical and physical safeguards designed to protect the Service and your data, as described on our Security page and in the Data Processing Agreement.

8. Intellectual property

We own the Service and all related software, designs and know-how. You own your data and the data you collect from End Users. You grant us the rights needed to provide the Service to you. If you send us feedback, we may use it without obligation to you.

9. Confidentiality

Each party will protect the other’s confidential information with reasonable care and use it only to perform under these Terms.

10. Disclaimer

Except as expressly stated in these Terms, the Service is provided “as is” and “as available”, and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law.

11. Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Each party’s total liability arising out of these Terms is limited to the fees you paid to us in the 12 months before the event giving rise to the claim. These limits do not apply to your payment obligations or to your obligations under Section 12.

12. Indemnity

You will defend and indemnify us against third-party claims arising from your use of the Service in breach of these Terms or applicable law, including any failure to obtain required notices or consents from End Users.

13. Term and termination

These Terms apply while you use the Service. Either party may terminate for the other’s material breach that is not cured within 30 days of notice. We may suspend the Service immediately to prevent harm, fraud or a breach of the Acceptable Use Policy. After termination you may export your data for 30 days, after which it is deleted under our retention schedule.

14. Changes to these Terms

We may update these Terms. We will give at least 30 days’ notice of material changes by email or in the dashboard. Continued use after changes take effect means you accept them.

15. General

These Terms are governed by applicable U.S. federal law and the laws of the state in which Securely Verify is organized, without regard to conflict-of-law rules. If any provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent. These Terms, together with the documents they reference, are the entire agreement about the Service.
